NSSGA’s Johnson: Biden Administration Must Follow Buy America Exclusion

The National Stone, Sand & Gravel Association (NSSGA) President and CEO Michael Johnson issued a statement on the industry’s bipartisan Buy America exclusion that was issued as part of the Infrastructure Investment and Jobs Act legislation. 

In his State of the Union address, President Biden reiterated the expansion of the Buy America provision for construction materials, which was included in IIJA, however written into the law is an exclusion for the industry.

“In last night’s State of the Union address, President Biden discussed the Buy America expansion to construction materials,l” Johnson said. “The Infrastructure Investment and Jobs Act (IIJA) included an expansion to the Buy America provision and excludes aggregates, cement, binder and additives and their mixed products from these requirements. This action to create the exclusion and ultimately include it in the law, as written by Congress, demonstrates the clear intent to exclude these materials.

“Regardless of his comments, the Biden Administration still must follow the law as intended. This exclusion has been included in previous guidance from the Office of Management and Budget, as well as the Department of Transportation. NSSGA will continue to work with the administration and federal agencies to ensure the regulation is implemented according to the law and does not negatively affect infrastructure projects and modernization,” Johnson concluded.
