Jan. 19, 2023 – Inside sources say that the Mine Safety and Health Administration’s (MSHA) proposed silica rule has now been submitted to the Office of Management and Budget (OMB) and is currently under review, which is the final step before the rule can be published in the Federal Register. No definitive word on what the content of the bill is, however in his January column, Rock Products legal columnist Brian Hendrix of Husch Blackwell predicted that the train was approaching the station. Now that we know it will be arriving soon, we will all know better what the rule has in store. To that end, Hendrix also pointed out that after the Occupational Safety and Health Administration (OSHA) finalized its silica rule in 2016, former MSHA Assistant Secretary Joe Main said that MSHA would use OSHA’s work on its rule to support the proposed rule MSHA was drafting.
