NSSGA Approves of TSCA

June 10, 2016 – President Obama is expected to sign the Toxic Substance Control Act (TSCA) soon, now that both chambers of Congress approved the first update to regulating toxic chemicals in 26 years. Unlike recent regulations pushed out by the administration, The National Stone, Sand and Gravel Association (NSSGA) supported the TSCA modernization bill and the final measure includes language suggested by the association. The legislation instructs the Environmental Protection Agency (EPA) to start a new risk review process, and requires the agency to give priority to substances that persist and accumulate in humans. Based on EPA’s risk assessment for a given chemical, the agency is required to issue risk management rules. The new requirements can include anything from new labels to an outright ban. NSSGA will actively oppose any attempt by EPA to regulate common rock dust particles.
