Suit Filed Against Quarries


A motions hearing has been set for a lawsuit that three couples living near the Bremer Quarry, south of Lake City, Minn., have filed against Wabasha County and the quarry, according to the Post Bulletin, Rochester, Minn.

In the lawsuit filed May 10, Dennis and Ruth Weber, John and Lorraine Brinkman, and Rodger and Sylvia Brown ask the court to toss out the Wabasha County Board's approval of a conditional-use permit that allows the quarry to continue operating. It didn't have such a permit for several years.

Neighbors have said in public meetings that the quarry is seeking to expand well beyond its original limits and is causing noise problems for them and some nearby subdivisions.

The three couples want the court to give a joint planning board jurisdiction over the decision and to void the permit. The board was formed in 2000 to have planning and land-use control over unincorporated land within two miles of Lake City. The quarry is within that zone.
